[Government Code section 4217.12]
ENTERING INTO AN ENERGY SERVICES CONTRACT
NOTICE IS HEREBY GIVEN of the intention of the Board of Trustees of the East Side Union High School District (“District”) to consider entering into an energy services contract (“Agreement”) with Bay City Mechanical Service, LLC to design and install new Air Conditioning equipment, smoke detectors, P traps, condensate piping and extend to existing condensate on roof, gas valves at each unit and modify gas piping as needed, and Pelican Wireless Systems Thermostats for each of the 7 rooftop units at Silver Creek High School Library, 3434 Silver Creek Road, San Jose, CA 95121, pursuant to the terms of Government Code section 4217.12.
The time for the public hearing on the intention of the Board to consider entering into the Agreement is October 22, 2020 at 6:20 p.m., or as soon thereafter as practicable, during the Board’s regular meeting. Due to the Santa Clara County Public Health Department’s Shelter In Place Order and as permitted by the Governor’s Executive Order No. N-29-20, the meeting will be held via videoconferencing. At such time the testimony of all interested persons for or against the proposed Agreement will be heard. Any protest pertaining to the regularity or sufficiency of the proceedings shall be in writing and shall clearly set forth the irregularities and defects to which the objection is made. Any written protest shall be filed with the Clerk of the District on or before the time set for the hearing. The District may waive any irregularities in the form or content of any written notice and at the hearing may correct minor defects in the proceedings. Written protests may be withdrawn, in writing, at any time before the conclusion of the hearing.
